CCI issues justifying impediment confirmation notices under the Regulation on issuing notices to confirm impediments justifying non-fulfillment of obligations No 35/1 of 25.09.2020, as amended by decision of CCI’s Executive Bureau No 47/5 of 26 November 2021.
The justifying impediment confirmation service is also known as a Force Majeure Certificate (please note that the concept of “force majeure” has been replaced by “impediment justifying non-fulfillment of obligations” under the Civil Code), which is regulated internationally by the International Chamber of Commerce.
It is the international CCI that has developed the force majeure model clause which is of particular importance for any international commercial contract since it is the one that allows exemption from liability for non-fulfillment of contractual obligations.
The procedure for issuing notices is to be applied in commercial contractual relations in which at least one party is involved in entrepreneurial activity and in which the parties of such a contract have agreed in writing to obtain CCI’s confirmation.
According to the procedure, the applicant shall submit the application and supporting documents, in the case of an electronically signed application, by accessing the page https://eclient.chamber.md/ro/auth/login.
At the same time, documents can be submitted at CCI’s main office 151 Stefan cel Mare si Sfant Blvd, Chisinau).
The application shall be according to the form (HERE) and shall specify the nature of the impediment – factual and detailed description of the event and statements confirming that contractual obligations cannot be fulfilled. Upon request, businesses shall also attach the contract and supporting documents.
The notice of confirmation shall be issued within up to 30 calendar days from the date of filing the application and documents.
Note: The Regulation of the Chamber of Commerce and Industry of the Republic of Moldova on the issuance of the opinion certifying the justifying impediment to the non-performance of an obligation was published in the Official Monitor of the Republic of Moldova on October 2, 2020. This Regulation was developed pursuant to Article 4 of Law No. 393/1999 on the Chamber of Commerce and Industry, as subsequently amended, and also taking into account the recommendations of the International Chamber of Commerce in Paris.
